Supplementing the Labour Code: Law no. 241/2023

This addition to the Labour Code is aimed at regulating a new benefit for employees, namely the possibility for employees who have dependent children up to the age of 11 to request to work remotely or from home at least four days a month, except in situations where the nature or type of work does not allow the activity to be carried out under such conditions.

In detail

Law no. 241/2023 introduced a new article to the Labour Code to provide employees who have dependent children up to 11 years old the opportunity, upon request, to work remotely or from home for four days per month, under the conditions established by Law no. 81/2018 on the regulation of remote working activity, except in situations where the nature or type of work does not allow the activity to be carried out under such conditions.

If both parents or legal representatives of the children are employees, the request of a parent or legal representative to work remotely or from home has to be accompanied by a declaration of own responsibility by the other parent or legal representative stating that they did not, for the same period, also request to work remotely or from home.

In the case of a single parent or sole legal representative, such a statement is not required.

Employees who request to work remotely or from home must have all the necessary means to fulfil their duties according to their job description.
